This website and the WaLead platform (hereinafter, the "Service" or "WaLead"), accessible via walead.ai and its subdomains, are owned by:

WaLead is an independent application with its own API. It is not a Chrome extension.

These Terms and Conditions (hereinafter, the "Terms") govern the access, registration, and use of the Service by any natural or legal person (hereinafter, the "User").

Use of the Service implies full and unreserved acceptance of these Terms. If the User does not agree with any of the clauses, they must refrain from using the Service.

These Terms are complemented by the Privacy Policy and the Cookie Policy, accessible from the website.

• Service or WaLead: the SaaS platform for B2B prospecting, LinkedIn automation, contact database, enrichment, AI agents, Copilot, and other features accessible from walead.ai.
• User: the natural or legal person who registers for and uses the Service.
• Account: the User's personal space within the Service.
• Workspace: the working environment of the User or their organization within the platform.
• Credits: the unit of consumption within the Service used to access AI features, enrichment, and other measurable actions.
• Plan: the subscription tier contracted by the User.

To use the Service, it is necessary to create an account by providing a valid email address and the User's LinkedIn profile URL.

The User undertakes to:

• Provide truthful and up-to-date information.
• Maintain the confidentiality of their access credentials.
• Immediately notify WaLead of any unauthorized use of their account.

WaLead reserves the right to suspend or cancel accounts that breach these Terms, without giving rise to any compensation.

WaLead is a Go-to-Market (GTM) SaaS platform that provides the User with an integrated set of features for B2B prospecting, data enrichment, sales automation, and operating with AI agents. Among others:

• B2B database with more than 16 million verified contacts.
• LinkedIn prospecting automation with a proprietary safety system (Health Score, dedicated proxies, and adaptive limits).
• Native AI agents: Finder, Screener, Scorer, Prospector, Closer, and Copilot.
• Waterfall data enrichment with multiple providers.
• Workbook and modules for managing lead and company lists.
• Integrations with CRMs, email tools, and third-party services.
• Access to the platform via MCP from tools such as ChatGPT, Claude, and other compatible AI agents.

WaLead may modify, expand, or discontinue features of the Service at any time, giving notice where reasonably possible.

WaLead offers a 30-day free trial.

During the trial period:

• The User may access the features included in the trial plan.
• At the end of the period, the User may freely decide whether to contract a paid plan.
• If the User does not contract a plan, their account will switch to a limited mode or be suspended.

WaLead reserves the right to limit the free trial to one per person, company, or payment method.

The Service is offered under different subscription plans, whose prices and conditions are detailed on the pricing page of the website.

Credit model:

• The consumption of AI features, enrichment, and other measurable actions is carried out through a credit system.
• Reference rate: 1 credit = €0.05 (subject to the conditions of the contracted plan).
• LinkedIn actions (invitations, messages, visits) do not consume credits.
• The credits included in each plan renew periodically according to the billing cycle. Unused credits do not carry over between cycles, unless the contracted plan states otherwise.

WaLead may modify the prices, the features included in each plan, and the value of the credit, giving the User reasonable advance notice. Changes will not affect the current billing cycle.

Payments are processed through external providers, primarily Stripe. WaLead does not directly store or process payment card data.

• Subscriptions renew automatically at the end of each cycle, unless cancelled beforehand.
• The prices shown do not include applicable taxes, which will be calculated and added at the time of charge according to the User's jurisdiction.

The User may cancel their subscription at any time from their account settings. The cancellation will take effect at the end of the current billing cycle, maintaining access to the Service until then.

Refund policy:

• Fees already invoiced are non-refundable, except where legally required otherwise.
• Consumed credits are non-refundable under any circumstances.
• In exceptional cases (technical error attributable to WaLead, double charge, etc.), WaLead may issue refunds at its discretion.

The User undertakes to use the Service:

• In accordance with applicable legislation, in particular the GDPR and the LSSI (Spanish Information Society Services Act).
• Respecting the Terms and Conditions of LinkedIn and of any other platform with which the Service integrates.
• Without harming third parties, and without using the Service to send spam or unlawful, offensive content, or content that infringes intellectual property rights.
• Without attempting to access restricted parts of the Service, decompile the software, or perform reverse engineering.

The following is expressly prohibited:

• Using the Service to send unsolicited commercial communications in breach of applicable regulations.
• Creating multiple accounts to circumvent limits or free trials.
• Reselling, sublicensing, or redistributing the Service without express authorization.
• Using the Service for fraudulent or deceptive activities, or that constitute harassment, impersonation, or defamation.
• Uploading content that infringes the rights of third parties.
• Using the Service or any of its features (database, enrichment, AI agents, LinkedIn automation, integrations, MCPs) for purposes contrary to applicable legislation or to the terms of use of the third-party platforms with which the Service integrates.

Failure to comply with these conditions may lead to the suspension or cancellation of the account without prior notice, as well as to the corresponding legal action. Use of the Service is undertaken at the sole responsibility of the User. WaLead is not responsible for improper, fraudulent, abusive, or unlawful use of the Service, nor for the consequences arising from such use by the User or by third parties with access to their account.

WaLead integrates AI features using proprietary and third-party models (Anthropic, OpenAI, xAI, among others).

• The content generated by the AI agents (prospecting messages, replies, scores, summaries, etc.) is based on the information provided by the User and on publicly available data.
• The User is solely responsible for reviewing, editing, and validating the AI-generated content before using it.
• WaLead does not guarantee the accuracy, suitability, or absence of errors in the generated content.
• The User undertakes not to use the AI features to generate illegal, offensive, discriminatory, or misleading content.

WaLead is an independent GTM platform that, among other features, offers LinkedIn automation. This clause specifically governs that feature.

WaLead is not affiliated with, sponsored by, authorized by, or connected to LinkedIn Corporation.

• Using the Service to automate actions on LinkedIn is undertaken at the sole responsibility of the User.
• WaLead applies technical measures aimed at safe and responsible use (Health Score, dedicated proxies, adaptive limits), but does not guarantee the absence of blocks, suspensions, or restrictions by LinkedIn.
• WaLead is not responsible for the consequences arising from the suspension, restriction, or cancellation of the User's LinkedIn accounts.
• The User must ensure that their use of the Service complies with LinkedIn's Terms of Use.

Although WaLead is a LinkedIn Certified Partner, this certification does not imply that WaLead acts on behalf of LinkedIn or that LinkedIn guarantees or endorses its features.

• All intellectual and industrial property rights of the Service (software, design, trademarks, content, documentation) are the exclusive property of WaLead or its licensors.
• WaLead grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.
• The data generated by the User (lead lists, campaigns, messages, configurations) is the property of the User. WaLead acts as a data processor in accordance with the Privacy Policy.
• The enriched data obtained through the Service may be used by the User solely for legitimate purposes related to their business activity and in accordance with applicable data protection legislation.

The processing of personal data is governed by WaLead's Privacy Policy, which forms an integral part of these Terms.

Key points:

• Data is hosted on servers located in the European Union.
• WaLead applies technical and organizational measures aligned with the principles of the SOC 2 standard.
• The User has the right to access, rectify, erase, restrict, object to, and port their personal data in accordance with the GDPR.

The Service is offered "as is" and "as available".

WaLead does not warrant:

• That the Service is free of errors or interruptions.
• That it will meet specific expectations of commercial results (number of meetings, conversions, revenue, etc.).
• Permanent compatibility with third-party services (LinkedIn, CRMs, enrichment providers), whose terms may change unilaterally.

WaLead makes reasonable efforts to maintain high availability, but does not guarantee a specific SLA unless expressly agreed in writing under an enterprise plan.

To the maximum extent permitted by law, WaLead shall not be liable for:

• Indirect damages, loss of profits, loss of business opportunities, loss of data, or reputational harm.
• Actions by LinkedIn or other third parties against the User's accounts.
• Improper use of the Service by the User or by third parties with access to their account.
• Content generated by AI agents that the User decides to send to third parties.

WaLead's maximum liability, in any event, shall be limited to the amount actually paid by the User in the twelve (12) months prior to the event giving rise to the claim.

WaLead may modify the Service and these Terms at any time. Modifications will be published on this page and, where materially relevant, will be notified to the User by email.

Continued use of the Service after the modifications take effect implies acceptance of them. If the User does not agree, they may cancel their subscription in accordance with clause 9.

WaLead may suspend or cancel access to the Service in the following cases:

• Breach of these Terms.
• Non-payment of the corresponding fees.
• Fraudulent, abusive, or unlawful use contrary to applicable legislation.
• Legal requirement or requirement from a competent authority.

In the event of termination, the User may request the export of their data for a reasonable period. Once that period has elapsed, the data may be deleted in accordance with the Privacy Policy.

WaLead shall not be liable for the failure to perform or the defective performance of its obligations when this is due to force majeure or unforeseeable circumstances (natural disasters, failures of essential providers, cyberattacks, governmental decisions, armed conflicts, etc.).

WaLead may assign these Terms and the rights arising from them to any successor in the event of a merger, acquisition, or sale of assets. The User may not assign their rights without the prior written consent of WaLead.

If any clause of these Terms is declared null or unenforceable, the remaining clauses shall remain in full force. The parties shall negotiate in good faith a replacement clause that most closely approximates the purpose of the original.

These Terms are governed by Spanish law.

For the resolution of any dispute arising from the interpretation or performance of these Terms, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Tarragona, expressly waiving any other jurisdiction that may correspond to them.

Where the User is a consumer within the meaning of consumer protection legislation, the jurisdiction legally corresponding to them shall apply.
